What to Do After a Car Accident in Northern Virginia

Here is a straightforward checklist on what to do after a car accident in Virginia.

1. Stop and Ensure Safety

First, bring your vehicle to a stop as soon as it is safe. Under Virginia law (Code § 46.2-894), you are required to stop at the scene of any accident involving injury or property damage.

  • Check for Injuries: Check yourself and your passengers. If anyone is injured, call 911 immediately.

  • Move to Safety: If the accident is minor (no injuries) and your vehicle is movable, Virginia law requires you to move the vehicle to the shoulder or a safe location to avoid blocking traffic.

  • Turn on Hazard Lights: Make your vehicle visible to other drivers.

2. Call the Police

It is generally recommended to call the police to establish an official record of the event.

Virginia’s Reporting Rules: Law enforcement officers in Virginia are generally required to file a written crash report if the accident results in injury, death, or property damage estimated to be over $3,000 (Code § 46.2-373).

  • In Fairfax County: You can call the non-emergency line (703-691-2131) if there are no injuries and the vehicles are not blocking traffic.

  • Get the Case Number: If an officer responds, ask for the police report number or "case number" to give to your insurance company.

3. Exchange Information

While waiting for the police or after moving to a safe spot, exchange the following information with the other driver:

  • Full Name and Contact Information

  • Insurance Company Name and Policy Number

  • Driver’s License Number

  • License Plate Number

  • Vehicle Make, Model, and Color

Tip: Using your phone to take clear photos of the other driver’s documents is often faster and more accurate than writing it down.

4. Be Mindful of What You Say

5. Document the Scene

  • Context: Traffic signs, signals, and road conditions.

6. Notify Your Insurance Company

You Have the Right to Choose: Under Virginia law (Code § 38.2-517), your insurance company cannot require you to use a specific repair shop. While they may recommend a shop from their network, the final choice is yours.
